The “Culture with private copy” Association wishes to emphasize the cogency of the decision by the Albis Commission on the tariffs for different copy devices. This decision provides for bringing into compliance the calculation of tariffs with the Conseil d’État (the French Supreme Administrative Court) decree requesting exclusion of taking into account illegal sources.

The Albis commission adopted tariffs in compliance with the Conseil d’État decree excluding copies of illegal sources.

The representatives of rights holders (authors, performers and producers) within the commission on private copy levies express their satisfaction with the decision made at the meeting held on Wednesday 17 December chaired by Tristan d’Albis.

The decision voted then, with support from consumer organizations, bears on the main digital devices subject to private copy levies since 2001 (data CD, data DVD, external hard drives, USB flash drives, memory cards, home audio, video and multimedia recording devices and portable MP3 and MP4 players).

On the basis of a study by the Institut TNS SOFRES requested by the commission, its members prepared tariffs for amounts identical to those currently applicable, complying both with the rule set by the Conseil d’État decree and the updating of the other parameters contributing to their definition.

Thus, this decision fully applies the Conseil d’État decision of last July excluding from calculation of levies all copies made from illegal sources.

The commission also proceeded with setting a new tariff covering all telephones that can be used for making private copies of musical, audiovisual, literary content and still images. The new tariff, which also excludes copies from illegal sources, was adopted on the basis of a study requested by the commission from the Institut CSA to have the most recent information on consumer practices.

NB: the commission is made up of two equally represented colleges, 12 members for those paying the levies (industrialists and representatives of consumers) and 12 members for the beneficiaries of the levies (through SORECOP, COPIE FRANCE, AVA and SORIMAGE).
